Justice

Criminal cases are heard on the last day of each tenday. Depending on the severity of the crime, the case will be heard by one of two tribunals.

Crimes involving punishment levels V - III are heard by the Mayor, the Chief Justice, and the councilman from the Temple of Helm.

Crimes involving punishment levels II or I are heard by the High Lord, the Knight-Marshall, and the Chief Justice. The councilman from the Temple of Helm will provide magical interrogation. Note that invasive magic is allowed only in this level of proceeding.

If the crime has a standard punishment of levels V or IV, the accused remains free, and is expected to make their way to the Council Chambers on the appropriate day. For levels III - I, the accused is imprisoned until the day of the trial.

Both accused and accuser have the right to an advocate to make their case to the tribunal, and to have witnesses provide testimony. An advocate will be assigned to the accused if they do not or can not select one. Decisions of the tribunal are final, barring extraordinary circumstances, or the introduction of new evidence.

Possible Sentences

  • Level V - Fine
    • A specified amount of money. Proceeds are added to the city defense fund.
  • Level IV - Labor
    • A specified number of eight-hour days, working under supervision of the army, typically on city defenses
  • Level III - Imprisonment
    • A specified number of days kept in confinement in the city dungeon
  • Level II - Banishment
    • A specified number of months during which the guilty party may not trespass on any lands controlled by the High Lord
  • Level I - Execution
    • Execution by beheading
    • Sentence to be carried out by the Knight-Marshall or High Lord
    • Sentence to be carried out in public, witnessed by the Chief Justice, at least one Knight-Commander, and the Mayor.

Crimes of Violence

  • Assault
    • Defined as: attacking another with a weapon causing injury (provision is made for self-defense)
    • Infraction: (Imprisonment) 1 year
    • Major infraction: Against an unarmed person; (Banishment) Permanent
    • Severe infraction: Against a woman, child, or elder, or nobility; (Execution)
  • Brawling
    • Defined as: starting or involving oneself in a fight without weapons (provision is made for self-defense)
    • Infraction: Without causing over 1gp of damage or requiring medical attention; (Fine) Amount of damage
    • Major infraction: That which has caused over 1gp of damage or significant wounds; (Fine) Double amount of damage, (Labor) 1 tenday
    • Repeat major infraction: (Labor) 2 tendays
  • Kidnapping:
    • Defined as: holding a person against their will
    • Major infraction: Released without harm; (Banishment) Permanent
    • Severe infraction: Harmed during captivity; (Execution)
  • Murder
    • Major infraction: Attempted; (Banishment) Permanent
    • Severe infraction: Actual, or attempted for pay; (Execution)
  • Rape
    • Severe infraction: Any attempted or actual; (Execution)
  • Threat of Arms
    • Defined as: drawing a weapon against those who are unarmed or otherwise unable to defend themselves
    • Infraction: Against an unarmed person; (Imprisonment) 1 month, (Labor) 1 month, temporary loss of permit to bear weapons
    • Major infraction: Against a woman, child, or the elderly; (Imprisonment) 3 months, (Fine) 10gp, permenant loss of permit to bear weapons
    • Severe infraction: Against nobility; (Imprisonment) 1 year, (Fine) 100gp, permanent loss of permit to bear weapons

Crimes of Property

  • Arson
    • Major infraction: Attempted; (Banishment) Permanent
    • Severe infraction: Actual; (Execution)
  • Desecration
    • Infraction: Attempted; (Imprisonment) 3 months, (Fine) 10gp
    • Major Infraction: Actual; (Banishment) 1 year
  • Theft
    • Minor infraction: 1gp or less; (Fine) double amount stolen, (Imprisonment) 1 day
    • Infraction: 1gp to 20gp; (Fine) double amount stolen, (Labor) 1 tenday
    • Major infraction: 20gp to 100gp; (Fine) double amount stolen, (Imprisonment) 3 months
    • Severe infraction: over 100gp; (Imprisonment) 1 year, (Labor) 1 year

Crimes of Neglect

  • Neglect
    • Infraction: Neglect causing harm of a domestic animal; (Labor) 1 tenday
    • Major infraction: Neglect causing death or a domestic animal, or harm to a person; (Imprisonment) 1 month, (Labor) 1 month
    • Severe infraction: Neglect causing death of a person, or harm to a child or elder; (Imprisonment) 1 year
  • Debtor
    • Defined as: owing a debt, especially to the government due to a fine, but also to a private citizen, for more than one month
    • Infraction: Any; (Labor) until debt is paid; 1sp paid to owed party per day of labor
  • Dereliction of Duty
    • Defined as: a failure in duty by one who has warrant from the city government, such as soldiers, guardsmen on duty, etc.
    • Infraction: Without causing harm; (Labor) 1 tenday
    • Major infraction: Causes harm; (Imprisonment) 3 months (Labor) 1 month
    • Severe infraction: Causes death; (Banishment) Permanent
  • Disobeying an Officer
    • For a normal citizen
      • Infraction: Without causing harm; (Imprisonment) 1 day
      • Major infraction: Causing harm; (Imprisonment) 1 month (Labor) 1 tenday
      • Severe infraction: Causing death; (Banishment) 1 year
    • For a member of the military
      • Infraction: Without causing harm; (Imprisonment) 1 tenday, (Labor) 1 month, rank reduced
      • Major infraction: Causing harm; (Imprisonment) 1 year, removed from military service
      • Severe infraction: Causing death; (Execution)

Crimes Against Justice

  • Defiance of Banishment
    • Crimes committed under defiance of banishment increase level of punishment
    • Major infraction: Any; (Imprisonment) Permanent
  • Impersonation
    • Infraction: Of a citizen; (Imprisonment) 1 month
    • Major infraction: Of an soldier or priest; (Imprisonment) 1 year
    • Severe infraction: Of nobility; (Banishment) Permanent
  • Perjury
    • Infraction: Lying in cases concerning punishment of level IV or V; (Imprisonment) 1 year
    • Repeat infraction: (Banishment) 1 year
    • Major infraction: Lying in any other case; (Banishment) 1 year
    • Repeat major infraction: (Banishment) Permanent

Crimes Against the City

  • License Evasion
    • Infraction: Accidental, previously kept up, and not more than one month without licence; (Fine) 50% of all income (not profit) during unlicensed term
    • Major infraction: Willful, or over one month; (Fine) All income from unlicensed term (Imprisonment) of leadership 1 month, no future license will be issued
  • Tax Evasion
    • Infraction: less than 5gp; (Imprisonment) 1 month
    • Major infraction: Over 5gp, or violation of magical sales or weapon sales tax; (Imprisonment) 3 months
  • Smuggling
    • Infraction: Import or export of a taxed item without paying appropriate tax; (Fine) Double value of item and tax
    • Major infraction: Import or export of a special taxed item without paying all appropriate taxes; (Imprisonment) 1 month, (Fine) Double value of item and tax
    • Severe infraction: Import or export of a banned item; (Banishment) 1 year

Crimes Against the Crown

  • Treason
    • Severe infraction: Any attempted or actual; (Execution)
